1. Agreement to Terms
By accessing and using the website and services of Dynamic Air Heating, Cooling and Gas Piping (hereinafter "Dynamic Air," "we," "us," "our," or "Company"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.
2. Service Description
Dynamic Air provides heating, cooling, gas piping, and commercial refrigeration services in Southwestern Ontario. Our services include but are not limited to:
- HVAC installation, repair, and maintenance
- Gas piping installation and service
- Commercial refrigeration systems
- Heating system assessments and upgrades
- Air conditioning installation and repair
- Consulting and system design services
3. Service Estimates and Quotes
Service estimates and quotes are provided in good faith based on information available at the time of assessment. Estimates are valid for 30 days unless otherwise specified in writing. Final pricing may vary based on:
- Actual site conditions discovered during installation
- Additional work required beyond the original scope
- Changes requested by the client after work has begun
- Material price fluctuations
- Labor cost adjustments due to unforeseen circumstances
We will notify you of any significant cost overruns before proceeding with work that exceeds the estimate by more than 10%.
4. Service Scheduling and Cancellation
Scheduling: Service appointments must be scheduled in advance. We make reasonable efforts to meet requested appointment times but do not guarantee specific appointment windows.
Cancellation: If you need to cancel an appointment, please provide at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee of $75, which will cover our service call preparation costs.
No-Show: If you fail to keep a scheduled appointment without prior notice or cancellation, you may be charged the full service call fee.
5. Payment Terms
Accepted Payment Methods: We accept cash, check, credit cards, and online transfers.
Payment Timing: Payment is due upon completion of service unless credit terms have been pre-arranged in writing. Service calls with outstanding invoices may result in suspension of future services.
Financing: We offer financing options for major system installations. Financing terms are subject to lender approval and will be detailed in a separate financing agreement.
Late Payment: Invoices not paid within 30 days are considered past due. Late accounts may incur an interest charge of 1.5% per month (18% annually) or the maximum rate allowed by law, whichever is less.
6. Warranties and Disclaimers
Manufacturer Warranties: All equipment supplied carries the manufacturer's warranty. We will provide warranty documentation with your system. Manufacturer warranties are non-transferable unless explicitly stated by the manufacturer.
Labor Warranty: We warrant our workmanship for a period of one year from the date of completion. This warranty covers defective installation only. Warranty does not cover damage due to improper use, neglect, unauthorized repairs, or normal wear and tear.
System Warranty Conditions: Some manufacturer warranties require regular maintenance. Failure to maintain your system as recommended may void warranties. We offer maintenance plans to help you maintain manufacturer warranty coverage.
Disclaimer: We do not warrant that services will be uninterrupted, timely, secure, or error-free. We do not warrant that defects will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.
7. Limitation of Liability
In no event shall Dynamic Air, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, even if advised of the possibility of such damages.
Our total liability for any claim arising from or relating to these Terms shall not exceed the amount paid by you for the specific service in question.
This limitation applies to all claims regardless of the form of action or the basis of the claim, including breach of contract, tort, strict liability, or any other legal theory.
8. Customer Responsibility
The customer is responsible for:
- Providing safe and accessible work areas for our technicians
- Disclosing any known hazards or special conditions in the home or building
- Providing accurate information about existing systems and conditions
- Arranging for necessary permits and inspections where required
- Following all maintenance and operation instructions provided
- Scheduling regular maintenance as recommended
9. Liability Waiver for Accidents
While our technicians take all reasonable precautions to prevent damage, Dynamic Air is not responsible for damage to property resulting from normal service activities, including minor marks, dust, or incidental damage. For major property damage claims, our liability is limited to the amount paid for the service that caused the damage, up to the insurance coverage limits maintained by Dynamic Air.
10. Licensed and Certified Services
Dynamic Air is a licensed HVAC contractor. All technicians performing gas piping work are certified in accordance with Ontario Regulation 941 and hold current certifications from the Technical Standards and Safety Authority (TSSA). All work is performed in accordance with applicable codes and regulations.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Ontario, Canada, and you irrevocably submit to the exclusive jurisdiction of the courts located in Ontario.
12. Dispute Resolution
In the event of a dispute, we encourage you to contact us directly to attempt resolution. If a satisfactory resolution cannot be reached, disputes may be subject to arbitration or litigation in accordance with Ontario law.
13. Safety and Hazards
Customers must disclose all known hazards including but not limited to:
- Asbestos or other hazardous materials
- Mold or moisture issues
- Pest infestations
- Electrical hazards
- Structural issues
- Aggressive pets
- Unstable work areas
Failure to disclose hazards may result in suspension of service and charges for hazard mitigation.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes become effective upon posting to our website. Your continued use of our services after changes indicates your acceptance of the modified Terms.
